Defamation, Constitutive facts, Abuse of freedom of expression – Remarks against a journalist – Application of Article 1382 (no)
Defamatory remarks against a journalist fall exclusively under press law. Article 1382 of the Civil Code cannot be used as the basis for a claim for damages.
